If you become a HALS client, the terms of your representation are governed separately by a written representation agreement, as explained in Section 25.

3. Scope of HALS’s practice

HALS practices exclusively in the area of U.S. federal immigration and nationality law. Our practice is limited to representation before federal agencies — including USCIS, the Executive Office for Immigration Review (EOIR), Immigration and Customs Enforcement (ICE), Customs and Border Protection (CBP), and the U.S. Department of State — and before federal courts where applicable.

HALS may represent individuals located outside Illinois only in matters of federal immigration law. The authority to do so derives from the federal regulations governing representation before immigration agencies, not from a state license in the client’s state of residence. See Sperry v. Florida ex rel. Florida Bar, 373 U.S. 379 (1963); 8 C.F.R. § 292.1(a)(1); 8 C.F.R. § 1001.1(f).

HALS does not advise on the law of any state other than Illinois. If your matter involves criminal law, family law, employment law, tort law, estate law, or any other area of state law — even where that area affects your immigration situation — you should consult an attorney licensed in the relevant state. Nothing on this Website should be understood as advice on the law of a state in which HALS is not licensed to practice.

Nor does HALS advise on the immigration law of any country other than the United States, except as expressly agreed in writing.

4. For informational purposes only; not legal advice

The content of this Website — including practice-area pages, blog posts, videos, social media posts, FAQ content, downloadable guides, and any automated or interactive tool — is general information about immigration law and about HALS’s services. It is not, and is not intended to be, legal advice about your particular situation. Immigration law, and the way it is interpreted and enforced, can change rapidly; content that was accurate when published may become outdated without notice (see Section 9). The general information on this Website is never a substitute for a consultation with a qualified immigration attorney who has reviewed the specific facts of your case.

5. No attorney-client relationship

Visiting this Website, reading its content, submitting a contact or intake form, calling our office, emailing us, sending a text or WhatsApp message, interacting with us on social media, scheduling an appointment through our online scheduling tool, or sending information through this Website does not, by itself, create an attorney-client relationship between you and HALS or any of its attorneys.

An attorney-client relationship with HALS is formed only when: (a) HALS has completed a conflicts-of-interest check; (b) HALS has agreed, in writing, to represent you in a specific matter; and (c) both you and HALS have signed a written representation agreement describing the scope of that representation.

Paying for and completing an initial consultation does not, by itself, mean that HALS has agreed to represent you beyond that consultation. A consultation allows HALS to assess whether it can help you and allows you to assess whether you wish to retain HALS; ongoing representation begins only through a separate, express, written agreement.

Until that written representation agreement is signed, you should not consider HALS to be your attorney, and HALS is not obligated to take any action on your behalf, including any action described in Section 7.

6. Information you send us before becoming a client

If you send information to HALS before an attorney-client relationship exists — for example, through a Website form, by phone, email, text message, WhatsApp, or social media — it is important that you understand four things.

First: what protection that information has. The Illinois Rules of Professional Conduct grant certain confidentiality protections — though not unlimited ones — to information a person shares with an attorney for the purpose of seeking legal representation. HALS honors those obligations and does not waive them through these Terms.

Second: send only what is necessary. Please do not send highly sensitive information — such as detailed criminal history, medical or mental health records, financial account numbers, identification numbers, or the intimate details of abuse or of a crime of which you were a victim — through general Website forms, email, text message, or WhatsApp, unless and until HALS has agreed to represent you and has directed you to an appropriate secure channel. Provide only the general information reasonably necessary for us to determine whether we can help you.

Third: sending information does not guarantee that we can represent you. Before accepting any matter, HALS must complete a conflicts-of-interest check, which may reveal that HALS already represents, or previously represented, a party whose interests are adverse to yours, or that HALS cannot accept your matter for another reason. If a conflict exists, HALS may be unable to represent you and may be limited in what it can explain to you about the reason.

Fourth: information you send on your own initiative, without our having requested it, does not prevent HALS from representing another person. The unsolicited submission of information through this Website, by email, text message, WhatsApp, or social media does not create any duty for HALS to decline to represent another person whose interests may be adverse to yours, even in the same matter or a related matter, and you agree that such submission will not disqualify HALS or any of its attorneys from representing that other person. In immigration matters it is common for two people with opposing interests — for example, a petitioning spouse and a self-petitioner, or an employer and an employee — to approach the same firm. If you want the information you share with us to receive the treatment reserved for a prospective client with full conflict protections, do not send it through these channels: call our office and request a consultation.

Nothing in this Section is intended to, or has the effect of, waiving or limiting any duty of confidentiality HALS owes to prospective clients under the Illinois Rules of Professional Conduct.

7. Urgent matters and deadlines

Immigration matters frequently involve strict filing deadlines, hearing dates, and other time-sensitive requirements. Do not rely on a Website contact form, voicemail, email, text message, WhatsApp message, social media message, chatbot, or any other automated or delayed method of communication to meet an urgent deadline or to address an emergency immigration matter, including a detention, an upcoming hearing, or a filing deadline.

Sending information to HALS through this Website — or receiving an automated confirmation that your submission was received — does not mean that HALS has agreed to track any deadline on your behalf, file any application or petition, respond to USCIS, EOIR, ICE, CBP, the Department of State, or any other agency, appear at any hearing, take any action to protect your immigration status, or otherwise undertake legal action on your behalf. HALS assumes those obligations only once a written representation agreement exists (Section 5).

If you believe you are facing an emergency immigration matter, call our office directly at the number listed in Section 32, or contact another qualified immigration attorney immediately.

8. No guarantee of results

Immigration outcomes depend on your individual facts and evidence, on the laws and regulations in effect at the time, on the policies and practices of USCIS, EOIR, ICE, CBP, the Department of State, and other agencies, on the discretion of each adjudicator, judge, and officer, and on other circumstances beyond HALS’s control.

Statements on this Website about HALS’s experience, past case outcomes, client testimonials, reviews, or examples of past matters describe individual outcomes and do not predict or guarantee a similar outcome in any other case, including yours. HALS does not guarantee the approval of any application or petition, the timing of any government decision, any particular immigration status, or any other specific outcome.

9. Immigration law changes quickly: verify before acting

U.S. immigration law is governed by statutes, regulations, judicial decisions, executive actions, agency policy guidance, forms, filing fees, processing practices, and enforcement priorities that change, sometimes with little or no advance notice. Information on this Website that was accurate on the date it was published or last updated may no longer be accurate by the time you read it.

Before making any decision that could affect your legal rights or your immigration status — including decisions about filing an application, meeting a deadline, traveling or leaving the United States, changing employment, or interacting with immigration authorities — you should obtain individualized legal advice from HALS or another qualified immigration attorney, based on the current state of the law and your particular circumstances.

10. Services described on this Website

This Website describes categories of immigration matters HALS may be able to assist with, which, as of the Last Updated date above, may include VAWA self-petitions, U Visas, T Visas and other humanitarian visas, Special Immigrant Juvenile Status, asylum, adjustment of status, family petitions, immigration waivers (I-601, I-601A, I-212), administrative appeals, motions to reopen or reconsider, mandamus actions, and the “Immigrant Shield Plan” and “Immigration Risk Analysis” products described in Section 12.

The description of a category of immigration matter on this Website does not mean that HALS can or will accept every matter of that type, nor does it obligate HALS to accept any particular matter.

11. Appointments and consultations

This Website allows you to schedule a consultation through an online scheduling tool. As of the Last Updated date above, an initial consultation is offered for a set fee; see the scheduling page for the current price. Scheduling or paying for a consultation does not, by itself, constitute an agreement by HALS to provide ongoing representation in your matter beyond that consultation; such representation requires a separate written representation agreement, as described in Section 5.

Consultation and cancellation policy

Cost and advance payment. The consultation costs $50 USD with attorney Liliana Jones for a general immigration evaluation, and $100 USD with attorney Brenda Muñoz-Rigor for asylum, removal (deportation) defense, Special Immigrant Juvenile Status (SIJS), T visas, and other matters indicated at scheduling.

Cancellations and changes. Please give at least 48 hours’ notice through the channel indicated in your appointment confirmation. Your payment may be applied to another date at no additional cost, for the same type of consultation. If you give less notice or do not attend, a new appointment will cost $50 USD, regardless of the attorney or the matter, and will be subject to availability. If the office changes your appointment, it will be rescheduled at no additional cost.

Children at appointments. For appointments with both attorneys, we ask that you attend without children unless their presence is necessary for the consultation. If you do not have childcare options, please contact the office before your appointment.

Scope. The payment covers the consultation only; it does not include preparing or filing applications, hearings, or ongoing legal representation. Subsequent services and their fees require a separate agreement.

12. Immigrant Shield Plan and Immigration Risk Analysis

The Immigrant Shield Plan and the Immigration Risk Analysis are paid products governed exclusively by their own written contracts and not by these Terms. The description of these products on the Website is advertising and informational in nature. No description on the Website creates any right; the included services, their scope, price, activation conditions, term, refund of unearned fees, and the circumstances in which HALS may be unable to respond are established only in the applicable contract, which you must read and sign before paying.

No HALS service, including the Immigrant Shield Plan, prevents a detention, a deportation, or any action by an immigration authority, or guarantees an outcome. See Section 8.

13. Payments

HALS accepts online payments through this Website, which are processed through Stripe, and in-person or telephone credit card payments, which are processed through Authorize.net.

If HALS accepts online payments for a consultation or other service, that payment will be processed by a third-party payment processor, and your payment information will be subject to that processor’s terms and privacy practices, not HALS’s. HALS does not store your full payment card number in its own systems; it retains only the last four digits.

This Section does not create any refund, cancellation, or billing dispute policy; any such policy is established separately (see Sections 11 and 12).

14. Electronic communications

HALS may communicate with you by email, phone, text message/SMS, WhatsApp, Website forms, social media messaging, videoconference, and other electronic means. No method of electronic communication is completely secure, and email, text messages, WhatsApp, and social media messages in particular may be intercepted, lost, or accessed by unauthorized third parties. Do not use any of these channels to send highly sensitive information (see Section 6), and do not consider them an appropriate way to raise an emergency or time-sensitive matter (see Section 7). By communicating with HALS electronically, you accept these inherent risks.

15. SMS and phone communications; consent

HALS may use phone calls and text messages to communicate with prospective clients and clients about consultations, scheduling, and, where applicable, matters related to their case.

To receive text messages and calls from HALS, you must give your express authorization. This authorization is requested through a checkbox on the contact form of this Website and in service agreements, with the following text:

“I authorize HALS to contact me by text message and phone call at the number I provided, including through automated systems, about my inquiry and my case. This authorization is not a condition of receiving any service. Message frequency may vary. Message and data rates from your carrier may apply. Reply STOP to stop receiving messages or HELP for help. We do not share your number or this authorization with third parties for their own marketing purposes.”

Calling or texting HALS, or providing your phone number through this Website, does not create an attorney-client relationship (Section 5) or replace the guidance on urgent matters in Section 7.

16. Artificial intelligence, chatbots, and automated systems

HALS may currently use, or may use in the future, automated tools on this Website or in its communications, including chatbots, automated intake questionnaires, automated eligibility-screening tools, voice agents, or automated email or text message responses (together, “Automated Tools”).

Any response, suggestion, or output generated by an Automated Tool is provided for general informational purposes only, has not necessarily been reviewed by an attorney before being sent to you, and does not constitute legal advice. An Automated Tool cannot determine your eligibility for any immigration benefit, predict the outcome of your case, or substitute for the individualized legal advice of a licensed attorney. You should not rely solely on an Automated Tool’s response when making any decision about your immigration matter. Interacting with an Automated Tool, like any other use of this Website, does not create an attorney-client relationship (Section 5).

17. Third-party websites, tools, and services

This Website may link to, embed, or use third-party websites, platforms, and tools, including appointment-scheduling platforms, payment processors, intake or customer-relationship-management systems, analytics providers, government agency websites, social media platforms, videoconferencing tools, mapping services, and embedded media such as video or review widgets.

HALS does not control these third-party services and is not responsible for their content, availability, security, or privacy practices. Your use of any third-party site, platform, or tool linked from or integrated into this Website is subject to that third party’s own terms and privacy policy, which we recommend you review. This Section does not restrict any use of the Content that applicable law does not permit HALS to restrict, such as fair use.

21. Acceptable use

By using this Website, you agree not to: violate any applicable law; attempt to gain unauthorized access to any part of the Website, its underlying systems, or any account; introduce viruses, malware, or other harmful code; interfere with or disrupt the operation or security of the Website; impersonate any person or entity, or misrepresent your affiliation; scrape, harvest, or collect data from the Website by automated means without HALS’s prior written permission; or submit fraudulent, false, or misleading information through any Website form. HALS may suspend or restrict access to the Website for anyone it reasonably believes has violated this Section.

22. Website availability and accuracy

HALS makes reasonable efforts to keep the content of this Website useful, accurate, and available, but does not guarantee that the Website will be complete, current, uninterrupted, secure, or error-free. The Website may be modified, suspended, or discontinued, in whole or in part, at any time and without notice. Nothing in this Section limits any professional duty HALS owes to its clients or prospective clients under the Illinois Rules of Professional Conduct, duties that this Section does not and cannot waive.

23. Disclaimer of warranties

To the maximum extent permitted by applicable law, this Website and its Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. HALS does not guarantee that this Website will meet your requirements, that it will be uninterrupted, timely, secure, or error-free, or that any information obtained through the Website will be accurate or reliable.

24. Limitation of liability

This Section relates solely to use of the public Website and reliance on its general content. It does not apply to the attorney-client relationship.

To the maximum extent permitted by applicable law, HALS will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, this Website or its Content.

This Section does not limit, and is not intended to limit, any liability HALS has toward a client arising from an actual attorney-client relationship, which is governed exclusively by the applicable representation agreement, the Illinois Rules of Professional Conduct, and applicable law. Nor does this Section limit any liability in cases where applicable law does not permit its limitation.

25. Relationship to legal representation

These Terms govern only the use of this Website. If you become a HALS client, the scope of representation, fees, and the rights and obligations of HALS and the client are governed exclusively by the written representation agreement you sign, together with the Illinois Rules of Professional Conduct and other applicable law, and not by these Terms. If anything in these Terms conflicts with your signed representation agreement regarding the scope or conditions of legal representation, the representation agreement controls.

26. Attorney advertising notice

Portions of this Website — including the description of HALS’s services, its attorneys’ experience, and client outcomes — are intended to inform the public about the availability of legal services and may constitute attorney advertising under applicable rules of professional conduct.

No part of this Website is intended as a communication directed to a specific person known to need legal services in a particular matter.

27. Testimonials, reviews, and case outcomes

This Website may display client testimonials, reviews, video content, or descriptions of past case outcomes. Each describes the experience or outcome of a specific client, based on that client’s particular facts and circumstances. These statements are not a guarantee, promise, or prediction regarding the outcome of your matter or of any future matter, which, as described in Section 8, depends on your own facts and on factors beyond HALS’s control.

Every testimonial, image, video, or case outcome published on this Website is published with the informed, written consent of the person involved.

28. Governing law and jurisdiction

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or related to your use of this Website — and not arising from an actual attorney-client relationship, which is governed separately under Section 25 — will be subject to the exclusive jurisdiction of the state courts located in DuPage County, Illinois, or the United States District Court for the Northern District of Illinois, and you consent to the personal jurisdiction of those courts.

29. Changes to these Terms

HALS may update these Terms periodically. The “Last Updated” date at the top reflects the most recent revision. Your continued use of the Website after a revised version is posted constitutes your acceptance of the revised Terms. We encourage you to review them periodically.

Version control owner: Liliana Jones, Esq.

30. Language

This Website is offered in Spanish and in English. Both versions have equal value. HALS has made a good-faith effort to ensure that the Spanish and English versions of this Website, including these Terms, convey the same meaning. If you believe there is a discrepancy between the two versions, please contact us using the information in Section 32 so that we can clarify it.

31. Severability

If a court of competent jurisdiction determines that any provision of these Terms is invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

32.
